A sea lion was killed by its captors today up in Tacoma. Yesterday, it was swimming freely in the Columbia, where its ancestors have been free to swim for thousands of years. But its freedom was taken from it, because it committed the crime of eating salmon, its natural and native prey. (This is an act which humans do with impunity, but for which sea lions are threatened with the death penalty.) While dams and voracious human fishermen drive our salmon toward extinction, the newspapers label sea lions as "salmon scarfing" and promote the myth that it is they, and not us, who are killing off all the salmon. Willful or not, this is ignorance. And today, a sea lion paid for our ignorance with its life.

Yesterday, April 28, 2008, about a hundred Natives and non-Native supporters marched along and blocked-off a major trucking route in East Vancouver, Coast Salish Territory, for several hours starting at about 3:00 PM, in solidarity with the struggle at Tyendinaga and Six Nations. An article by The New York Times's Mark Mazzetti this morning discloses a letter (.pdf) from the Justice Department to Congress which asserts "that American intelligence operatives attempting to thwart terrorist attacks can legally use interrogation methods that might otherwise be prohibited under international law." In other words, even after all of the dramatic anti-torture laws and other decrees, the Bush administration insists that American interrogators have the right to use methods that are widely considered violations of the Geneva Conventions if we decide that doing so might help "thwart terrorist attacks."

There are two reasons, and two reasons only, that the Bush administration is able to claim this power: John McCain and the Military Commissions Act. In September, 2006, McCain made a melodramatic display -- with great media fanfare -- of insisting that the MCA require compliance with the Geneva Conventions for all detainees. But while the MCA purports to require that, it also vested sole and unchallenged discretion in the President to determine what does and does not constitute a violation of the Conventions. After parading around as the righteous opponent of torture, McCain nonetheless endorsed and voted for the MCA, almost single-handedly ensuring its passage. That law pretends to compel compliance with the Conventions, while simultaneously vesting the President with the power to violate them -- precisely the power that the President is invoking here to proclaim that we have the right to use these methods. As Columbia Law Professor Michael Dorf wrote at the time:

banner world week In a last chance to commemorate World Lab Animal Liberation Week and World Week for Animals in Labs(WWAIL), local activists took to Lake Oswego's streets, & sidewalks to deliver their message of compassion toward animals and disgust for vivisectors, to Eliot Spindel's house, a ONPRC Researcher for OHSU. Standing across the street, in silence, after a brief intro, vigil attendees held signs, cameras, and candles. The event even sparked a flame in a local neighbor to quickly go inside and make a sign, then came back out and join-in. (holding a sign that read "you suck" over at Spindel's house.)
