* Authorize a one-time exception to Human Resources Administrative Rule 8.03 to allow hour for hour overtime for Fair Labor Standards Act exempt employees assigned to TOPOFF between October 15, 2007 and October 19, 2007 (Ordinance)
The City of Portland ordains:
Section 1. The Council finds:
1.
The City is engaged in a major homeland security exercise designated as TOPOFF IV. All phases of preparation for this exercise require considerable staff time. During the exercise many employees will be required to work 12 to 14 hour shifts.

Pursuant to Human Resources Administrative Rule 8.03 employees who are exempt from the Fair Labor Standards Act (FLSA) are not entitled to overtime except for additional hours necessitated by an emergency as declared by the Mayor. TOPOFF is not an actual emergency but participation in the exercise provides the City with valuable training in preparation for a major emergency.

Although non-represented, FLSA exempt employees may be awarded up to 80 hours of management leave in recognition of additional hours worked in a calendar year pursuant to Human Resources Administrative Rule 8.03, given the time of year TOPOFF is occurring, many would be unable to use such leave if awarded this calendar year. Leave that is not used in the calendar year it is awarded is forfeited. In addition some of the employees impacted by their participation in TOPOFF are represented and not eligible for management leave or overtime.

It is, therefore, prudent to provide for a one-time exception to the provisions of Human Resources Administrative Rule 8.03 to authorize hour for hour overtime for those employees assigned to TOPOFF between October 15, 2007 and October 19, 2007 and who are working more than 40 hours per workweek during this time period.
NOW, THEREFORE, the Council directs:
a.
A one-time exception to Human Resources Administrative Rule 8.03 to authorize hour for hour overtime for FLSA exempt employees participating in TOPOFF who are assigned to work more than 40 hours a week from October 15, 2007 through October 19.
b.
The Bureau of Human Resources to meet with representatives of the Portland Firefighters Association and the Portland Police Commanding Officers Association to obtain their agreement to provide overtime as outlined in this ordinance to their members who are FLSA exempt and do not receive overtime under their collective bargaining agreements.
