I read both the clackamas county circuit court complaint and the US district court complaint. In reference to the circuit court complaint, am I reading correctly, that the entire series of events began with the incident at the Safeway parking lot as Carlos attempted to respond to his son's request for assistance?

I hope that you get your trial date, and that you have good witnesses. Naturally, the police are going to say Carlos interfered with efforts by officers to perform their duty at the Safeway parking lot. The rest, related to racism, falsifying reports, false arrest, they'll just deny, so Carlos lawyer better be able to prove the allegations. Guessing on the basis of name only, sounds like at least one of the defendants may be of hispanic descent, so they'll fall back on the old claim of "what? sandy police rascist? we have hispanics on our force. one of the arresting officers was hispanic!".

Oregon City Newspaper, Front Page,This past week reports, that On June 24th,2006
CLackamas County Deputy's responding to noise at the 172nd Ave Grange in Happy Valley,encountered a riot of more than 200 !!!


The PIO for the county reported," It was pretty hairy - when you have thAT MANY PEOPLE TURN AGAINST YOU "
When the mob mentality and alcohol and people whom are not well disposed towards the police mix it up,it can turn ugly fast"
First Officers on scene called for back up from all over the county,and other Police jurisdiction..ASAP. 4 cops from Sandy and 8 from Portland Police Bureau.
Det Strovink the PIO,stated we just dont have the manpower."
(Lets see.....how many are still out on paid adminstrative leave for officer in volved shootings ???)
The mob was fighting themselves upon arrival, however it quickly turned toward attacking the cops...(lOVELY !!!!)
The 200 plus WAS MOSTLY HISPANIC in ORGIN,AND 3 MAIN GUYS (HISPANIC WERE TAKEN IN FOR CAUSING THE ROIT,AND INTERFERING WITH AN OFFICER/ RESISTING ARREST/CONCELED WEOPON (ONE WAS GRABBING HIS NUB-CHCKS TO USE ON THE COPS,BUT WAS QUICKLY TAZERED....One citizen was roped into police duty to watch a handcuffed rioter,so the cops could keep arresting away.

All is well again...in Happy Vally...

Det. Stovink. Hmmm. Wouldn't that be the same Strovink who is heard idiotically laughing and joking about the shooting of Fouad Kaady in the moments after Mr. Kaady's murder by a Sandy police officer and a Clackamas County Sheriff? Yes, indeed, I believe it would be. For those who are curious, you might try asking for a copy of the audio recording of this episode, since it is, after all, "public record." Or, you could do what I did, and just access the material on your own, without their permission, since they are unlikely to grant it to you, as it makes them all look like callous, butchering, incompetent, assinine, thugs.

The story of corruption, cowardice, and murder among our rural law enforcement klan is not over, not by a long shot.

This is just the beginning, there is much, much more to come. Have a little patience, even though patience has no place when murders have been committed, but try. And yes, Strovink's recording that night will be heard, maybe on CNN.

Actually, the fact that one of the arresting officers is hispanic isn't relevant.

The Fourth (prohibiting unreasonable search and seizure), Eighth (barring cruel and unusual punishment), and Fourteenth (prohibiting any state from depriving any person of life, liberty, or property, without due process of law) amendments provide protections against human rights violations by police officers.

Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, or national origin by recipients of Federal financial aid. In addition, if a law enforcement agency receives Federal financial assistance under the Omnibus Crime Control and Safe Streets Act of 1968, it may not discriminate on the basis of sex or religion either.

However, police officers can also be prosecuted criminally under civil rights statutes if s/he is acting "under color of law" and "willfully subjects any person... to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States... ." Conspiracy can also be charged under the same statutes. The 1994 omnibus crime bill made civil rights violations capital crimes. 18 U.S.C. 241.

Among the Federal rights covered by these statutes is the right to be free from the willful use of excessive force. Per the U.S. Department of Justice, these laws apply to law enforcement agencies regardless of whether they receive Federal financial assistance and violations need not be based on race, color, national origin, etc.

Also, under 42 U.S. Code, section 1983, individuals may file civil lawsuits against the offending officer, department or jurisdiction. Monell v. Dept. of Social Services of the City of New York (1978).
