Eugene court dates/Daniel McGowan update

I talked to the Fed Courts today in Eugene and the following is the information I got.
According to the Federal Courthouse in Eugene, Daniel McGowan went to court in Judge Coffin's courtroom on Dec 22, 2005. He was there for both his initial hearing and also an arraignment. He entered a NOT GUILTY plea. His counsel has 21 days to present a motion now to the court. Both sides have 10 days to exchange discovery materials now.

The status conference for Daniel is set for Jan 9, 2006, at 1:30 pm, in the Eugene Federal Courthouse. The presence of the accused is required. You may call the court clerk's office at 541-465-6423 to make sure it is happening at that time close to the date. At the status conference, they will determine if the case is ready to go to trial.

The jury trial for Daniel McGowan is set for March 1, 2006 at 9 am in Judge Hogan's courtroom. Remember this could change based on the status hearing and other factors. Always call to make sure.

I am hoping to see the courtroom PACKED on Jan 9 for Daniel. I will be going down to Eugene to cover that hearing as a reporter and to show support. I encourage others to also do so. I encourage carpools from Seattle to head down as well.

Daniel is currently being held at Lane County Jail following his court appearance on
Thursday in Eugene for his arraignment. He was read his charges and plead Not
Guilty. We apologize for not getting an email about about this but this was all very
last minute. We appreciate that people who are in Eugene have been passing current
information on to us. Because of the holidays, it has been hard to receive and pass
information quickly. I hope you understand.

In terms of writing to Daniel, we are not sure if he will be held at Lane County
until his bail hearing (as far as we know, set for January 9) or if he will be sent
back to Sheridan in the meantime. It is your call where you would like to send
letters to. Here are the addresses. Please note in county jail he is given a
different ID number. Remember not to use any nicknames and keep in mind all his mail
is read.

His sister, Lisa, was able to speak with him for the first time today. She said he
sounded very clear and he was emotionally strong. She explained to him everything we
have all been doing for him and he was happy, impressed and overwhelmingly honored
about it all. She also explained we have been sending tons of letters but they
haven't been reaching him because he has been moving around. Daniel requested that
if you get a letter sent back to you, please resend to him at his current address.
One thing I am doing at the moment is sending the same letter to both Lane County
and Sheridan since I have no idea where he will be by the time the letter reaches
that side of the country.

Daniel would also like me to compile a list of everyone's addresses because he
hasn't gotten most of the letters and sometimes they do not give him the envelope.
Please email me at  jennyms@earthlink.net with your full name (no nicknames) and
address and I will make sure he gets this list in the next few days.

One last thing. In Daniel's first letter to me while still in NYC, he had written
out a list of notes he wanted to pass on to different people. I would like to share
with you the one he wanted me to give to his friends.

"Friends, be thankful for everything. Cherish every moment + piece of food, + friend
+ drink of water. I didn't + I'm full of regret in so many ways. Thanks for coming
to court + being there for me. I love you all. Please put aside the differences +
work together."

Because of everyone's support, Daniel is staying strong and considers himself a very
fortunate person right now.

An article in the Register Guard dated Dec 23, 2005, says "Daniel McGowan of New York City appeared in court Thursday for the first time since his arrest in New York. Coffin set Feb. 28 for his trial on charges that he set fire to a lumber mill office in Glendale and a tree farm in Clatskanie."

My info from Thursday from Eugene Fed Courthouse said he was going to trial in Judge Hogan's courtroom, not Coffin. And on Mar 1, not Feb 28, so on Mon, or tues, whenever the Eugene courthouse opens again, I will try to get some clarity on this.

Update on Daniel's address and mailing
Here is the latest on Daniel's address and mail requirements (Thank you Kirsten!)

Daniel's address is W. 5th Avenue, not 5th Street as had been previously posted.

So, Daniel's address right now is:

If you sent to 5th street, he should still get it, it just may take longer.

He can get letters with just pen and paper or print, but nothing inside, no glitter, etc. Also standard postcards are allowed. They said if inmates get enough glitter it can be a weapon for eyes so they are not allowed anything with glitter on it. Also, please put your address on the envelope and inside the letter. Try to use both sides of the paper as he is only allowed 20 pages total to have on him at a time.

They said we can send pictures but not polaroid pictures as they have two parts where things can be hidden. You can also only send up to 8 photos. If you want to send books they have to be from the publisher, although powells.com has listed on their site they can send books to Oregon prisons, but in county jail the books must be new. No incoming calls to inmates are allowed but the inmates can call you collect. Collect calls can only be made to land lines - no cell phones or voice over ip phones. Also, call forwarding is not allowed and will disconnect the call.

Visitation seems improbable for anyone outside of family and attorney. Apparently they get to list 3 people on a visit list and they can change those 3 people every 4 weeks. Depending on the classification of the inmate, they can have 1-3 visits a week most commonly, outside of attorney visits, the jail said.

Please keep in mind that Daniel does not have easy access to paper and pens at the moment so you may not hear back from him for a while. But know that he appreciates your letters so much.
