Heads up - FBI and Homeland security prowling for OR Enviros, AR activists

Two Portland residents were approached in a cafe today by 3 FBI agents, 1 agent from Homeland Security, and an Oregon Sheriff. They were given grand jury subpoenas and told that the FBI either had, or were hoping to, make several arrests.
The only other information available right now is that the subpoena's may be related to a fire at a Poplar tree farm, and that one of the agents present, Millicent "Millie" Tompa, is from Minnesota and has previous experience harassing animal rights activists. Keep your heads up and let people know to be alert.

An activist in New York who is well known for his prisoner support work was arrested and had his apartment raided today. He is being charged with arson and it appears his arrest is related to these subpoenas. More info as it becomes available.

Jamie Moran of the Jeffrey Luers Support Network was arrested today by Federal agents who also searched his Brooklyn apartment.

Although unconfirmed, the charges may be related to an arson investigation in Oregon.

Show your support for this incredibly dedicated activist at the bail hearing tommorow morning.

Court will be held at 225 Cadman Plaza East in Brooklyn, in the Federal Court Building, 2nd Floor.

The following NYC subway lines stop in the vicinity of the Courthouse. The 2 and 3 trains stop at Borough Hall and Clark Street. The numbers 4, 5 and the M and R stop at Court Street/Borough hall. The A, C and F trains stop at Jay Street/Borough Hall. The A and C trains also stop a High Street. However, since this is not a very populous station, it is not recommended.

The following lines stop at Borough Hall: B25, B26, B37, B38, B41, B45, B51, B54, B61, B65, B67, B75.

I (shannon (nonny) urick) and frank winbigler were the 2 people given supoenas today as we were leaving pho jasmine restaurant in portland,oregon. we are ordered to testify at a grand jury in eugene on march 16. we were also given letters advising us that we are both targets of the grand jury. any information on others who were either arrested or supoenaed would be greatly appreciated.

I (Jennifer Adrian) was also served a subpeona today, December 7, 2005.

I was approached at my workplace by two FBI agents, and was told that many arrests had been made across the country today for animal rights actions. I was also told that many other people were talking, and was pressured to "come clean" for my own good. When I insisted on talking to an attorney, I was issued a subpeona for a Grand Jury set for the same date as the one listed for the other people mentioned here.

I was told I would see all kinds of arrests on the news tonight, but I didn't see anything, so I was looking on the Internet for information and found your site.

Six arrested in connection with Northwest eco-terror attacks

SEATTLE - The U.S. Attorney's Office in Seattle says six people have been arrested for investigation of eco-terrorism in the Northwest.

All six people have been indicted by federal grand juries in Washington or Oregon.

The charges relate to four separate arsons in the Northwest, dating back to 1998, and the destruction of a Bonneville Power Administration tower at the Millennium.

The arrests were made Wednesday in New York, Virginia, Oregon and Arizona.

Stanislas Gregory Meyerhoff, 28, and Daniel Gerard McGowan, 31, were indicted in Oregon for the Jan. 2, 2001 arson at the Superior Lumber Co. in Glendale, Ore. and the May 21, 2001 arson at the Jefferson Poplar Farm in Clatskanie, Ore. The damages in each of those fires exceeded $1 million.

Kevin M. Tubbs, 36, and William C. Rodgers, 40, were indicted in Washington for the June 21, 1998 arson at the Animal and Plant and Health Inspection Services facility in Olympia. Damage from this arson was estimated at $1.2 million.

Sarah Kendall Harvey, 28, was indicted in Oregon for the Dec. 27, 1998 arson at the U.S. Forest Industries in Medfore, Ore. That fire caused an estimated $500,000 in damage.

Chelsea Dawn Gerlach, 28, is charged with two counts related to the Dec. 30, 1999 destruction of a Bonneville Power Administration power transmission tower near Bend, Ore.

The U.S. Attorney's Office says in many of the fires, the Animal Liberation Front (ALF) and Earth Liberation Front (ELF) claimed responsibility.

The indictments and arrests are the result of a nine-year investigation by the FBI, ATF, the Eugene Police Dept., the Portland Police Bureau, the Oregon State Police, the U.S. Forest Service, the U.S. Bureau of Land Management, the U.S. Department of Agriculture, the Oregon Department of Justice and the Lane County Sheriff's Office.

People can't help but buy uncritically into the frames of references around them. So we buy into the idea of being an "activist", that is using our real names, and openly challenging aggression and severe alienation called the "status quo".

As reality is revealed more and more openly (instead of just marginally against "acceptable" enemies and others too weak to be adequately heard and those not yet articulate enough), we will see how all manner of state-subordinated institutions work their games.

For some it's "too late" (and they may be quite willing, at first, to "sacrifice" themselves), but for others, you can still educate yourself and make necessary adaptations. Oh, *you can still engage in social challenge*, but with this input in mind, you can do it in a much more successful manner and avoid pre-emptive attacks and the ways the "status quo" uses the court system to deplete our wills and our resources.

It sounds really stupid, but popularity counts in courtrooms. It is very important that people show up in person to these hearings to show support for the safety of the accused. I wrote an article on this, it is at  http://portland.indymedia.org/en/2004/08/294930.shtml. The lawyers I interviewed in that article said that judges do not like being watched and they also need reelection and if you show they are being watched, they behave differently. Take a tip from Michael Jackson, pack that courtroom with family and friends to make the judge know he/she will be watched every step of the way. Lawyers I talked to on this also said it was important to pack the courtroom to humanize the accused past an identity solely reliant on the accused crime. In court, they automatically label the plaintiff the "victim," etc. and it is very manipulative language use.

I also just wanted to make sure people, not just the accused, understand what plea bargains are. Any time you plea bargain, you lose ALL rights to appeal later. If Jeff Luers had taken a plea bargain, for example, they could have STILL given him 22 years in prison even if he had accepted a plea bargain for lesser years and charges, and even if the prosecutor recommended lesser years and charges, the judge can still not accept that. I took a plea bargain once, being told it would reduce my sentencing to one week of community service, but when I got to the judge, 2 weeks after 9/11, I was given maximium sentencing ANYWAY as the judge hated my activism history, so why on earth I took the plea "bargain" is beyond me. Public defenders do not take the time to explain anything to you, so often it is like you are simply repping yourself if you have a public defender. Many people take plea bargains and say they are guilty when they are not and now, have no right to appeal. If you take a plea bargain, you are done. They throw away the key and it is unbelievably hard to get an appeal after a plea bargain. Plea bargains are torture for confessions, they are confessions made under duress, and just because someone admits guilt in a plea bargain, it in no way reflects actual guilt. I also wrote an article on plea bargains at  http://portland.indymedia.org/en/2005/12/330056.shtml to explain the way that contracts made under duress are voidable in law, yet somehow something as important as confessions in the criminal system are not given anywhere near that standard of an arm's length bargaining for legitimacy that contract law is.

Also, remember silence is golden in these situations. Do not EVER fall for the good cop - bad cop crap. ANYONE in the criminal justice system is to not be trusted EVER. It is a corrupt system where minorities and the poor fill the jails...and it ain't due to guilt. It is due to not having proper legal counsel. If all activists had high paid private attorneys like Johnny Cochran, 90% less of the activists in jail would be there now. I can say with all honestly that if you can get a private attorney in a courtroom, it will improve your chances for freedom 100 fold, as compared to relying on underfunded overworked public defenders. Money buys legal rights and freedom in America's courtrooms. Poverty buys plea bargains and fake guilty confessions made under duress with no room for later appeal. This is not legal advice; this is simply practical knowledge based on first hand experience.

Are there any hearings the public can attend regarding any of these west coast accused? I am willing to go down to Eugene and Portland to cover these hearings as a legal reporter (I used to be the city minutes recorder for Eugene, so I know their system a bit better and I have legal training), but I need to know when and where they are being held. I am trying to figure out how all this is going down and will be posting things I learn, as I learn them.

I just talked to Kent Robinson of the Or Criminal Division, and he said there will be a hearing at 1:30 pm in Eugene at the Fed Courthouse on Monday, Dec 12 for Chelsea Dawn Gerlach. Please make a showing at this hearing. Kent also said that all of the charges are out of Eugene, Or except for two, coming out of Wa State. He said that those charged with crimes from Oregon who were detained outside of Or, such as NY, will be sent by Marshall to the Oregon area within the next couple of weeks. He said that Tubbs and Rodgers will be sent to Wa State as that is where they are charged out of. I have seen rumors on the internet re some charge re a UW horticulture lab arson, but that seems to just be a rumor, the ONLY charges in this coming out of Wa St are around the Tubbs and Rodgers cases for an alleged action in Oly.

I also talked to the Public Affairs Officer for the US attorney's office in Seattle, Emily Langlie. She said that the two charged from Wa st are in the process of detention hearings right now. She said they can be held for flight risk or risk of public danger. She said that Tubbs had a hearing in Eugene today or yesterday and he will be sent to the US District Court in Tacoma, Wa. for his arraignment hearing shortly, if detained. She said that Rodgers is having a detention hearing in AZ next week, and if he is detained, he will also be sent via a marshall to Tacoma within the next month.

I am planning on going to Eugene to cover many of these hearings as a reporter. I hope as many indy media reporters as possible make this a priority as the accused are already not getting a fair shake in mainstream media before even being arraigned!

Darren Thurston was arrested on Wednesday in Portland in the company of Chelsea D. Gerlach and is currently being held at an INS Detention Facility in Tacoma, Washington. He has been served with a Deportation Order (back to Canada) on the grounds of his previous criminal record (from 1992). He has also been served with a Grand Jury Subpoena for February 16th, 2006 and told that he is a target of the investigation.

As many of you may be aware, there will be a hearing tomorrow at the Federal Courthouse for Chelsea Gerlach. This will be a public hearing and all who have the best interests of Chelsea in mind are welcome to attend.
As her family, however, we would like to stress the importance and power of a silent presence. We, and more importantly the judge, will not tolerate anything but the strictest orderly conduct. This is not the time or place for political statements, but for quiet observation. Anything less will only harm Chelsea's chances of release.

When I read the article about Homeland Security and the FBI after Enviros and AR, I'd like to add that, I have been massing info for about 7 years now, and after the Salem Oregon bust of a heroin "ring", I know what's coming...As my info suggests, Oregon is "broke", and has recognised that the FEDs have bigger toys, more money and man-power---All Oregon has to do is make ANYTHING sound like an "organization" or a "ring", and by power of the RICO ACT, they can use the FEDS to do their dirty work. I think we will be seeing a lot of common crimes become "rings" and federal manpower bringing indictments to match.

The Salem bust was just your ordinary drug dealer, as they have operated for decades. But now the local cops are getting creative anough to make a case for the FEDs. This is only a TEST DRIVE. The result, if it works, is longer prison sentences for many more people. Now, who you know really can land you in a federal prison. And what "anon" has said about informants that may not exist is absolutely true. I can vouch for that fact, since an illegal surveillance that I know of was transformed into an alleged "informant" who did not exist.

We need to pull together as a community and fight back, else we'll all be guests of the BOP.
