what a troubling story this is, particularly in how those claiming for Terri's civil rights are being branded as "nuts." Gee, thanks corporate America. Civil rights claims get national media time calling people "nuts." And corporate media ignores how easy it is to poke a hole through the husband's conflict of interest story about "persistant vegetative state".

The wife is an example of how her husband has successfully squashed her own civil rights, so far.

I'm sorry for editorializing here, though this is an excellent example of
how both sides are spinning an issue of 'right to life' and 'euthanasia' when the particular case is far grayer than these abstracts: particularly
if her husband actually attempted to murder her in 1990!.... and
particuarly since the woman can eye-track, move around a bit,
communicate, and the sworn affadavits of the nurses and the opinion of
forensic patholgists on Terri likely being assaulted in 1990, and
opinions of Nobel short listed doctors saying "we recover 'Terri's' all
the time', etc.

The issue is that her husband has little incentive to actually put Terri
through the rehabilitation (that even a Nobel short list doctor said was
possible), and just wants to 'off' his old wife because he alredy has a
new one as much as he can legally, with two children already.

What really fascinates me, personally, and frightens me, is how my very
left-wing father is totally so pro euthanasia in the abstract and even
hostile about "Terri's right to die" when he is unwilling to even see
evidence that may reevaluate such a discussion. The issue seems to be that
both sides are arguing civil rights issues, though different ones: the
husband claims "civil rights to euthanasia" when he may have conflicts of
interest in so proposing them though he has legal custody over Terri as
long as he can keep Terri's civil rights down and as long as he can
convince and keep medical treatment away from very likely a recoverable
Terri. The other side argues civil rights as well of course.

Some on the left are unwilling to even reevaluate the husband's claims
because he seems to see it as a test case for all euthanaia, instead of
treating this case as a left concern over handicapped individual civil
rights against the husband's claims, the latter which I (and the below
doctors) think is false. As I said above there is so much hot emotion not
necessarily over the Terri issue itself, though upon the two sides that
hate each other so much attempting to "claim Terri" as a political
football for either side's abstract case of civil rights, one of which I
think (the husband's is false).

And that gets into something slightly darker. What I don't understand is
how the TV media lording over all keeps getting to frame this as "Terri's
right to die" (and note that the judge has banned some of the
following video from his courtroom! why?!) when she seems to want to live
[read on] and can communicate. It's hardly a "persistant vegitative state"
either. Just who does this Michael S. know, and why is the media grabbing
this as some sort of "civil rights euthanasia test case," when it is so
much more than that in the particulars? To me it seems a case of "can we
get away with calling this a civil rights euthanasia test case and can we
get away with calling everyone else idiotic religious nuts" despite them
arguing on the basis of civil rights as well.

Read on, if you have the time. I'm archiving this data from my thought
process on this issue. I have made a super-summary of numbered titles of
the articles below for you to scan and save time. This is a story that
hits all the 'hatred buttons' of both the right and left for each other as
well as the 'value buttons' of the right and the left. A person's civil
rights in the middle of all these abstracts is being ignored, instead of
respected.

I still have lots of questions unanswered. Particularly one of my
questions is still, well, there seems to be a lot more going on than the
competition between how the husband wants this to be framed as a "civil
rights issue, right to die(TM)" and the family being framed as "religious
right-to lifers(TM)" when they are actually talking civil rights
throughout as well. The husband may have attempted to murder his wife and
failed in 1990--according to a FORENSIC PATHOLOGIST who has looked at
Terri's 1990 charts... That's below.

This could be a Shakespeare play: a murdering husband screaming about his
failed murderee's "right to die" in her "persistant vegetative state",
and he does his best (and somehow can get some handpicked doctors to
agree?) when none of these statements in quotes seem to be true at all. He
simply has little interest in seeing her living body rehabilitated,
because he already has another life with another woman and two children by
her. It's interesting though that he does "legally" he still has
jurisdiction over his wife in American law--though only as long as he can
keep her in the sense of "unrecoverable" and the sense of the judge
already denying Terri's own civil rights interestingly enough.

The husband and the judge are doing their damnest to see that she is
denied rehabiliation or the recogniztion of conflict of interest in the
husband that endangers her civil rights. I really don't know the full
story, and I'm still open on this, though the evidence below is hard to
ignore. I do know that I am unwilling to treat some person's life as some
sort of philosophical game between right and left for either side's
pleasure, particiuarly when it seems to me that the husband's side is
disingenuous.]

COUNTY OF PINELLAS )


BEFORE ME the undersigned authority personally appeared CARLA SAUER IYER,
R.N., who being first duly sworn, deposes and says:

1. My name is Carla Sauer Iyer. I am over the age of eighteen and make
this statement of my own personal knowledge.

2. I am a registered nurse in the State of Florida, having been licensed
continuously in Florida from 1997 to the present. Prior to that I was a
Licensed Practical Nurse for about four years.

3. I was employed at Palm Garden of Largo Convalescent Center in Largo,
Florida from April of 1995 to July 1996, while Terri Schiavo was a patient
there.

4. It was clear to me at Palm Gardens that all decisions regarding Terri
Schiavo were made by Michael Schiavo, with no allowance made for any
discussion, debate or normal professional judgment. My initial training
there consisted solely of the instruction "Do what Michael Schiavo tells
you or you will be terminated." This struck me as extremely odd.

5. I was very disturbed by the decision making protocol, as no allowance
whatsoever was made for professional responsibility. The atmosphere
throughout the facility was dominated by Mr. Schiavo's intimidation.
Everyone there, with the exception of several people who seemed to be
close to Michael, was intimidated by him. Michael Schiavo always had an
overbearing attitude, yelling numerous times such things as "This is my
order and you're going to follow it." He is very large and uses menacing
body language, such as standing too close to you, getting right in your
face and practically shouting.

6. To the best of my recollection, rehabilitation had been ordered for
Terri, but I never saw any being done or had any reason at all to believe
that there was ever any rehab of Terri done at Palm Gardens while I was
there. I became concerned because nothing was being done for Terri at all,
no antibiotics, no tests, no range of motion therapy, no stimulation, no
nothing. Michael said again and again that Terri should NOT get any rehab,
that there should be no range of motion whatsoever, or anything else. I
and a CNA named Roxy would give Terri range of motion anyway. One time I
put a wash cloth in Terri's hand to keep her fingers from curling
together, and Michael saw it and made me take it out, saying that was
therapy.

7. Terri's medical condition was systematically distorted and
misrepresented. When I worked with her, she was alert and oriented. Terri
spoke on a regular basis while in my presence, saying such things as
"mommy," and "help me." "Help me" was, in fact, one of her most frequent
utterances. I heard her say it hundreds of times. Terri would try to say
the word "pain" when she was in discomfort, but it came out more like
"pay." She didn't say the "n" sound very well. During her menses she would
indicate her discomfort by saying "pay" and moving her arms toward her
lower abdominal area. Other ways that she would indicate that she was in
pain included pursing her lips, grimacing, thrashing in bed, curling her
toes or moving her legs around. She would let you know when she had a
bowel movement by flipping up the covers and pulling on her diaper.

8. When I came into her room and said "Hi, Terri", she would always
recognize my voice and her name, and would turn her head all the way
toward me, saying "Haaaiiiii" sort of, as she did. I recognized this as a
"hi", which is very close to what it sounded like, the whole sound being
only a second or two long. When I told her humorous stories about my life
or something I read in the paper, Terri would chuckle, sometimes more a
giggle or laugh. She would move her whole body, upper and lower. Her legs
would sometimes be off the bed, and need to be repositioned. I made
numerous entries into the nursing notes in her chart, stating verbatim
what she said and her various behaviors, but by my next on-duty shift, the
notes would be deleted from her chart. Every time I made a positive entry
about any responsiveness of Terri's, someone would remove it after my
shift ended. Michael always demanded to see her chart as soon as he
arrived, and would take it in her room with him. I documented Terri's
rehab potential well, writing whole pages about Terri's responsiveness,
but they would always be deleted by the next time I saw her chart. The
reason I wrote so much was that everybody else seemed to be afraid to make
positive entries for fear of their jobs, but I felt very strongly that a
nurses job was to accurately record everything we see and hear that bears
on a patients condition and their family. I upheld the Nurses Practice
Act, and if it cost me my job, I was willing to accept that.

9. Throughout my time at Palm Gardens, Michael Schiavo was focused on
Terri's death. Michael would say "When is she going to die?," "Has she
died yet?" and "When is that bitch gonna die?" These statements were
common knowledge at Palm Gardens, as he would make them casually in
passing, without regard even for who he was talking to, as long as it was
a staff member. Other statements which I recall him making include "Can't
you do anything to accelerate her death - won't she ever die?" When she
wouldn't die, Michael would be furious. Michael was also adamant that the
family should not be given information. He made numerous statements such
as "Make sure the parents aren't contacted." I recorded Michael's
statements word for word in Terri's chart, but these entries were also
deleted after the end of my shift. Standing orders were that the family
wasn't to be contacted, in fact, there was a large sign in the front of
her chart that said under no circumstances was her family to be called,
call Michael immediately, but I would call them, anyway, because I thought
they should know about their daughter.

10. Any time Terri would be sick, like with a UTI or fluid buildup in her
lungs, colds, pneumonia, Michael would be visibly excited, thrilled even,
hoping that she would die. He would call me, as I was the nurse supervisor
on the floor, and ask for every little detail about her temperature, blood
pressure, etc., and would call back frequently asking if she was dead yet.
He would blurt out "I'm going to be rich!," and would talk about all the
things he would buy when Terri died, which included a new car, a new boat,
and going to Europe, among other things.

11. When Michael visited Terri, he always came alone and always had the
door closed and locked while he was with Terri. He would typically be
there about twenty minutes or so. When he left Terri would would be
trembling, crying hysterically, and would be very pale and have cold
sweats. It looked to me like Terri was having a hypoglycemic reaction, so
I'd check her blood

sugar. The glucometer reading would be so low it was below the range where
it would register an actual number reading. I would put dextrose in
Terri's mouth to counteract it. This happened about five times on my shift
as I recall. Normally Terri's blood sugar levels were very stable due to
the uniformity of her diet through tube feeding. It is my belief that
Michael injected Terri with Regular insulin, which is very fast acting.

12. The longer I was employed at Palm Gardens the more concerned I became
about patient care, both relating to Terri Schiavo, for the reasons I've
said, and other patients, too. There was an LPN named Carolyn Adams, known
as "Andy" Adams who was a particular concern. An unusual number of
patients seemed to die on her shift, but she was completely unconcerned,
making statements such as "They are old - let them die." I couldn't
believe her attitude or the fact that it didn't seem to attract any
attention. She made many comments about Terri being a waste of money, that
she should die. She said it was costing Michael a lot of money to keep her
alive, and that he complained about it constantly (I heard him complain
about it all the time, too.) Both Michael and Adams said that she would be
worth more to him if she were dead. I ultimately called the police
relative to this situation, and was terminated the next day. Other reasons
were cited, but I was convinced it was because of my "rocking the boat."

13. Ms. Adams was one of the people who did not seem to be intimidated by
Michael. In fact, they seemed to be very close, and Adams would do
whatever Michael told her. Michael sometimes called Adams at night and
spoke at length. I was not able to hear the content of these phone calls,
but I knew it was him talking to her because she would tell me afterward
and relay orders from him.

14. While at Palm Gardens, I became fearful for my personal safety. This
was due to Michael's constant intimidation, including his menacing body
language, vocal tone and mannerisms.

15. I have contacted the Schindler family because I just couldn't stand by
and let Terri die without the truth being known.

FURTHER AFFIANT SAYETH NAUGHT.

A certified nursing assistant who cared for Terri Schiavo in 1997 filed a
sworn affidavit in the case stating that she was able to feed Schiavo
normally on multiple occasions - but that husband Michael Schiavo would
only allow a feeding tube.

Heidi Law, a CNA at the Palm Gardens nursing home, testified:

"At least three times during any shift where I took care of Terri, I made
sure to give Terri a wet washcloth filled with ice chips, to keep her
mouth moistened. I personally saw her swallow the ice water and never saw
her gag.

"[Another CNA] and I frequently put orange juice or apple juice in her
washcloth to give her something nice to taste, which made her happy. On
three or four occasions I personally fed Terri small mouthfuls of Jello,
which she was able to swallow and enjoyed immensely."

Law testified that the only reason she didn't attempt to feed Ms. Schiavo
more frequently was "because I was so afraid of being caught by Michael."

Editorializing on the case in light of Law's account, the Pittsburgh Post
Gazette said Sunday: "It is one thing to withdraw a feeding tube; another
entirely to withhold that day's meal tray."

Carla Sauer Iyer was a registered nurse at the same facility. In her own
affidavit Iyer testified that Ms. Schiavo was capable of speech,
explaining, "[Terri] spoke on a regular basis, saying such things as
'Mommy' and 'help me.'"

When she put a washcloth in Terri's hands to keep her fingers from curling
together, Iyer said, "Michael saw it and made me take it out, saying that
was therapy" that he had forbidden.

"Throughout my time at Palm Gardens, Michael Schiavo was focused on
Terri's death," the RN noted. "Michael would say 'When is she going to
die?' 'Has she died yet?' and 'When is that bitch gonna die?'

ATTORNEYS LAST VISIT WITH TERRI SCHIAVO

On Friday, March 18, less than an hour after Sixth Circuit Court Judge
George W. Greer defied subpoenas issued by a Congressional committee for
Terri Schindler-Schiavo to appear as a federal witness in a Congressional
investigation, attorneys for Terris parents, Mary and Bob Schindler,
visited Terri to tell her that the death order was going to be executed
and that she would die.

When asked by her parents and their attorneys if she wanted to live,
Terri Schiavo made two conscious attempts to say Yeah and began to cry
when told that her husband, Michael Schiavo, would be removing her feeding
tube on orders of Judge Greer, which would result in her death by
starvation.

The Empire Journal has obtained an exclusive, first hand last visit
narrative by Barbara Weller who with David Gibbs III of the Gibbs Law
Firm of Seminole, Fl., is representing the Schindler family in their
efforts to save Terris life.

When Terri Schiavos feeding tube was removed at 1:45 p.m. on March 18,
2005, I was one of the most surprised people on the planet. I had been
visiting Terri throughout the morning with her family and her priest. As
part of the legal team working throughout the previous days and nights to
save Terri from a horrific fate, I was very hopeful. Although the state
judicial system had obviously failed Terri by not protecting her life, I
knew other forces were still at work. I fully expected the federal courts
would step in to reverse this injustice, just as they might for a prisoner
unjustly set for execution--although by much more humane means than Terri
would be executed. Barring that, I was certain that sometime around noon,
the Florida Department of Children and Family Services would come to the
Woodside Hospice facility in Pinellas Park and take Terri into protective
custody. Or that federal marshals would arrive from Washington D.C, where
the Congress was working furiously to try to save Terri, and would stand
guard at her door to prevent any medical personnel from entering her room
to remove the tube that was providing her nutrition and hydration.

Finally, I was sure if nothing else was working, that at 12:59, just
before the hour scheduled for Terris gruesome execution to begin, Florida
Gov. Jeb Bush would at least issue a 60-day reprieve for the legislative
bodies to complete the work they were attempting to do to save Terris life
and to make sure that no other vulnerable adults could be sentenced to
starve to death in America. I had done the legal research weeks before
and was fully convinced that Gov. Bush had the power, under our co-equal
branches of government, to issue a reprieve in the face of a judicial
death sentence intended to lead to the starvation and dehydration of an
innocent woman when scores of doctors and neurologists were saying she
could be helped.

All morning long, as I was in the room with Terri and her family, we were
telling her that help was on the way. Terri was in good spirits that
morning. The mood in her room was jovial, particularly around noontime,
as we knew Congressional attorneys were on the scene and many were working
hard to save Terris life. For most of that time, I was visiting and
talking with Terri along with Terris sister Suzanne Vitadamo, Suzannes
husband, and Terris aunt, who was visiting from New York to help provide
support for the family. A female Pinellas Park police office was
stationed at the door outside Terris room.

Terri was sitting up in her lounge chair, dressed and looking alert and
well. Her feeding tube had been plugged in around 11 a.m. and we all felt
good that she was still being fed. Suzanne and I were talking, joking,
and laughing with Terri, telling her she was going to go to Washington
D.C. to testify before Congress, which meant that finally Terris husband
Michael would be required to fix her wheelchair. After that Suzanne could
take Terri to the mall shopping and could wheel her outdoors every day to
feel the wind and sunshine on her face, something she has not been able to
do for more than five years.

At one point, I noticed Terris window blinds were pulled down. I went to
the window to raise them so Terri could look at the beautiful garden
outside her window and see the sun after several days of rain. As
sunlight came into the room, Terris eyes widened and she was obviously
very pleased. At another point, Suzanne and I told Terri she needed to
suck in all the food she could because she might not be getting anything
for a few days. During that time, Mary Schindler, Terris mother, joined
us for a bit, and we noticed there were bubbles in Terris feeding tube.
We joked that we didnt want her to begin burping, and called the nurses to
fix the feeding tube, which they did. Terris mother did not come back
into the room. This was a very difficult day for Bob and Mary Schindler.
I suspect they were less hopeful all along than I was, having lived
through Terris last two feeding tube removals.

Suzanne and I continued to talk and joke with Terri for probably an hour
or more. At one point Suzanne called Terri the bionic woman and I heard
Terri laugh out loud heartily for the first time since I have been
visiting with her. She laughed so hard that for the first time I noticed
the dimples in her cheeks.

The most dramatic event of this visit happened at one point when I was
sitting on Terris bed next to Suzanne. Terri was sitting in her lounge
chair and her aunt was standing at the foot of the chair. I stood up and
learned over Terri. I took her arms in both of my hands. I said to her,
Terri if you could only say I want to live this whole thing could be over
today. I begged her to try very hard to say, I want to live. To my
enormous shock and surprise, Terris eyes opened wide, she looked me square
in the face, and with a look of great concentration, she said, Ahhhhhhh.
Then, seeming to summon up all the strength she had, she virtually
screamed, Waaaaaaaa. She yelled so loudly that Michael Vitadamo, Suzannes
husband, and the female police officer who were then standing together
outside Terris door, clearly heard her. At that point, Terri had a look
of anguish on her face that I had never seen before and she seemed to be
struggling hard, but was unable to complete the sentence. She became very
frustrated and began to cry. I was horrified that I was obviously causing
Terri so much anguish. Suzanne and I began to stroke Terris face and hair
to comfort her. I told Terri I was very sorry. It had not been my
intention to upset her so much. Suzanne and I assured Terri that her
efforts were much appreciated and that she did not need to try to say
anything more. I promised Terri I would tell the world that she had tried
to say, I want to live.

Suzanne and I continued to visit and talk with Terri, along with other
family members who came and went in the room, until about 2:00 p.m. when
we were all told to leave after Judge Greer denied yet another motion for
stay and ordered the removal of the feeding tube to proceed. As we left
the room, the female police officer outside the door was valiantly
attempting to keep from crying.

Just as Terris husband Michael has told the world he must keep an alleged
promise to kill Terri, a promise remembered a million dollars and nearly a
decade after the fact; I must keep my promise to Terri immediately. Time
is running out for her. I went out to the banks of cameras outside the
hospice facility and told the story immediately. Now I must also tell the
story in writing for the world to hear. It may be the last effective
thing I can do to try to keep Terri alive so she can get the testing,
therapy, and rehabilitative help she so desperately needs before it is too
late.

About four in the afternoon, several hours after the feeding tube was
removed, I returned to Terris room. By that time she was alone except for
a male police officer now standing inside the door. When I entered the
room and began to speak to her, Terri started to cry and tried to speak to
me immediately. It was one of the most helpless feelings I have ever had.
Terri was looking very melancholy at that point and I had the sense she
was very upset that we had told her things were going to get better, but
instead, they were obviously getting worse. I had previously had the same
feeling when my own daughter was a baby who was hospitalized and was
crying and looking to me to rescue her from her hospital crib, something I
could not do. While I was in the room with Terri for the next half hour
or so, several other friends came to visit and I did a few press
interviews sitting right next to Terri. I again raised her window shade,
which had again been pulled down, so Terri could at least see the garden
and the sunshine from her lounge chair. I also turned the radio on in her
room before I left so that when she was alone, she would at least have
some music for comfort.

Just before I left the room, I leaned over Terri and spoke right into her
ear. I told her I was very sorry I had not been able to stop the feeding
tube from being taken out and I was very sorry I had to leave her alone.
But I reminded her that Jesus would stay right by her side even when no
one else was there with her. When I mentioned Jesus Name, Terri again
laughed out loud. She became very agitated and began loudly trying to
speak to me again. As Terri continued to laugh and try to speak, I
quietly prayed in her ear, kissed her, placed her in Jesus care, and left
the room.

Terri is alone now. As I write this last visit narrative, it is five in
the morning of March 19. Terri has been without food and water for nearly
17 hours. Im sure she is beginning at least become thirsty, if not
hungry. And I am left to wonder how many other people care.

PINELLAS PARK, FL (LifeNews.com) -- Just before representatives of her
estranged husband Michael removed her feeding tube Friday afternoon, Terri
Schiavo reportedly told an attorney for her parents that she wanted to
live.

Barbara Weller, one of the attorneys for Terri's parents Bob and Mary
Schindler, told reporters about her visit with Terri on Friday.

"Terri, if you would just say, 'I want to live,' all of this will be
over," she told the disabled woman.

Weller said Terri desperately tried to repeat Weller's words.

"'I waaaaannt ...,' Schiavo allegedly said. Weller described it as a
prolonged yell that was loud enough that police stationed nearby entered
the hospice room.

"She just started yelling, 'I waaaannt, I waaaannt,'" Weller explained.

At that point, police removed Weller from Terri's hospice room and, later,

Imagine for a moment that you are a Circuit Court Judge. A terrified woman
comes before your Court pleading for her life. She testifies, under oath,
that her violent and demented husband raped her, set her clothes on fire
and threatens to kill her. She needs your help and petitions your court
for an Injunction for Protection. What would you do? Well, this is what a
real Circuit Court Judge of the Sixth Judicial Circuit Court of Florida;
by the name of Judge George W. Greer decided.

He actually had this exact case come before his bench seven years ago,
when Helene Ball McGee, from Dunedin Florida pleaded with him to grant her
an Injunction for Protection. Helene was in absolute fear for her life.
Judge George W. Greer, however, refused to help her, because (according to
him) she had not shown him enough proof that her husband was physically
violent yet. Two weeks later her deranged husband, Bobby Lane McGee,
stabbed her to death. Perhaps if Bobby lane McGee, had raped Judge Greer
first, he would have had a much better insight into the physically violent
nature of her husband.

Now this same gender-biased Judge, with utter disdain for women, is the
same Judge in charge of the Terri Schindler Schiavo Case. True to form,
this Judge continues to ignore the Constitutional rights of Due Process
for Terri Schindler Schiavo, in much the same way he did to Helene Ball
McGee, who was violently murdered seven years ago this month. Terri who is
physically disabled, has trouble swallowing food on her own and because of
this Judge Greer has seen fit to order her feeding tube removed. Her Court
appointed 'Guardian' husband who has since abandoned her for another
woman, (with whom he has fathered two children) wants her dead and has
asked Judge Greer's permission to use hundreds of thousands of dollars
from her Medical Trust Fund Money to pay his blood-sucking lawyers to find
a way to make this happen.

It worked. Judge George W. Greer has now ignored her parents plea for help
and has ordered Terri's execution by starvation and dehydration to begin
on March 18, 2005. This cruel, torturous, and horrifying death of yet
another woman before his Court will take up to 10 days of horrific
suffering to cause her to die. But Judge Greer is not without mercy, no
sir; he will allow her parents permission to stay and watch their daughter
starve to death.

What is wrong with this picture? Is this the same United States of
America, whose US Supreme Court is inscribed with the words, 'Equal
Justice under law.' While Terri starves and cries out for justice; our
distinguished Supreme Court Justices will be too busy to hear, because
they will be deciding how best to abolish those embarrassing 'Ten
Commandments' of which, the Fifth Commandment is, 'Thou shall not kill.'

God help us. Every person of conscience in this Country should be ready to
travel to the Sixth Judicial Circuit Court House, in Pinellas County
Florida, and scream at the top of their lungs, that this is Murder! This
is Murder! This is Murder!

After you read Mr. Brodersen's letter many of you may ask why can't Terri
be given the proper therapy she needs so she can speak for herself?

Answer in short:

Keep in mind that Terri has repeatedly been denied by Michael Schiavo her
own legal counsel, therapy, and the right to present herself into a court
room. The family is NOT permitted to record or photograph her. Even if
they were allowed, Judge Greer has denied the right to provide evidence.

My name is Tom Brodersen. I am attorney Pat Anderson's office manager,
formerly her fiance, and more recently, her husband. I have personal
knowledge about Terri Schiavo's actual neurological condition and
responsiveness which we could not use before because of Pat's role as
attorney for the Schindler family. That is now changed, and I cannot sit
quietly by and passively observe a miscarriage of justice.

During the period of September to November of 2002 (from just before to
shortly after the medical evidentiary hearing featuring five doctors as
witnesses), I spent time with Terri Schiavo, as a person (briefly) on her
visitors list.

During that time I gently spoke to her, built rapport and trust, sang to
her, played music for her, and encouraged her to vocalize. Over the twenty
days or so that I visited with Terri, I observed that, while Terri is
distrustful of strangers, she gradually warmed up to me (and not so
gradually after Bob, Mary and I sang "Those Were the Days" to her as a
trio!). Terri responds to a variety of stimulii, including responding to
both her mother's and my voices, both in person and over the phone, by
fixing her attention and frequently by laughing.

When I sang to her, she often VOCALIZED, in her best effort to sing along
with me. She recognizes and takes great pleasure in certain singers and
songs which ARE her favorites (most especially John Denver singing
"Country Roads"). She learned to love several songs I sang to her with
which she didn't seem to be familiar with, but others she never learned to
appreciate (just not her cup of tea, obviously).

She responded to gentle requests if given time and patience, such as
lifting her right leg (three times out of four requests, the other time
she lifted her left leg instead).

While she does not have consistent control over her eyes to blink or look
this way or that, she has excellent control over her breathing, diaphram
and voice, and will vocalize in various patterns if asked. While trying to
work out a yes/no system with sounds, Terri initially answered the
question "Terri, are you ten feet tall" by moaning twice, which is the
response for "No," then she spontaneously whispered the word "No" in
response to the question "Terry, are you purple?".

At that point I abandoned the sounding system and started trying to teach
her to say "Yeah" as best as she could. Bob Schindler has several
recordings of her sort of saying the word "Yeah" shortly after that.

Unfortunately, I was then taken off Terri's visitors list, but on
successive occasions (as recently as last October, approximately two years
since I last saw her in person), when her father placed a phone to Terri's
ear so I could talk to her, she laughed as soon as she heard my voice, and
tried to sing along with me when I sang to her over the phone.

Terri is not just "in there," she is very responsive, she loves music, and
she is my friend. Please don't kill her.

This is no 'vegetable'. Look at her hands move, hear her respond with a
little 'yeh' in agreement with what her dad says. Terrie has 'acquired
cerebral palsy' and reminds me very much of my cousin Fredine who was born
69 years ago with 'spastic paralysis', better know as 'cerebral palsy'....
Fredine is as intelligent as you or I. With therapy, she learned to walk,
and how to control and relax her muscles more easily. She went to school
with me, in a grade ahead. Hard to understand sometimes, but with patience
and practice, you know what she is saying. Fredine has contributed a lot
to her family's enjoyment and enjoys life herself, as would Terri with the
proper therapy.

Terri CAN get better! Dr. Hammesfahr, the Nobel Prize candidate for his
work with the brain injured has examined her and declared so. Other
physicians have also examined her and know that she can improve with
therapy - the therapy which has been wrongly denied her. However, Judge
Greer and George Felos do not want to admit this in court. Judge Greer is
ignoring the truth. And so is the mainstream media until now.

Terri has always had very poor eyesight, even before the damaging
incident. Just because she can't recognize people until they are literally
in her face, does not mean she's not aware, has feelings, enjoys life,
music, pets, her family's comforting words, her pastor praying with her.

Boy, would she enjoy being wheeled out in the fresh air and sunshine! Lets
give her, and ALL of us that chance!

A world-renowned forensic pathologist with over 40 years experience as a
medical examiner is challenging the official version of early events in
the Terri-Schindler Schiavo case, providing the parents of the
brain-disabled woman with powerful ammunition in their battle to save
their daughter's life from her court-ordered starvation death.

Interviewed on the Fox News Channel, Dr. Michael Baden, co-director of the
Investigative Unit of New York State Police in Albany and former chief
medical examiner for New York City, ruled out potassium imbalance and a
heart attack as factors in Terri's mysterious collapse 13 years ago which
left her severely incapacitated and unable to speak and pointed to head
trauma and bone injuries as a more likely cause.

Baden explained to host Greta van Susteren it was unlikely for a woman of
Terri's age at the time to have a potassium imbalance, unless she had
certain types of diseases, which she didn't have.

"Too little potassium can cause the heart to stop beating properly and
lead to lack of blood flow to the brain and death of brain cells by lack
of oxygen, but that's very unusual, Greta, extremely unusual," he said.

That Terri's heart was healthy would rule out the likelihood of cardiac
arrest, he said.

"The reason she's in the state she's in is because there was a period of
time, maybe five minutes or eight minutes, when not enough oxygen was
going to her brain," said Baden. "That can happen because the heart stops
for 5 or 8 minutes, but she had a healthy heart, from what we can see."

Baden said he studied a bone scan made in March 1991 at a hospital that
describes her as having a head injury.

"A head injury can cause, can lead to the vegetative state that Ms.
Schiavo is in now," he continued, adding it showed evidence of other
injuries, including bone fractures.

Something totally different

Van Susteren asked if he were suggesting a potassium imbalance caused a
fall that led to a head injury, or perhaps some "pre-existing head injury
[led] to her passing out."

"Something totally different," he answered. Because cardiac arrests
triggered by low potassium are so rare, "the other issue is: could it have
been due to some other cause, which is raised by the family. [That] has to
be looked at."

Baden said the injuries suggested some kind of trauma: "The trauma can be
from an auto accident; the trauma can be from some kind of beating that
she obtained from somebody somewhere. It's something that should have been
investigated in 1991 when those findings were fresh," adding, "Maybe they
were. Maybe they were investigated by the police at that time."

Greta: Dr. Baden, a potassium imbalance, lets first talk about if you
have a potassium deficiency, can that cause the condition that Terri
Schiavo has?

Baden: Um, can, but unlikely. Potassium is very interesting. Its
probably the most lethal poison we have when its injected rapidly, and
thats why its the poison that kills people, capital punishment by lethal
injection. And it stops the heart from beating properly too much of it.
But also too little of it., hypo-potassium, can also cause the heart to
stop beating properly and lead to lack of blood flow to the brain and
death of brain cells by lack of oxygen. But thats very unusual, Greta,
extremely unusual.

Greta: A normal healthy woman, I assume, would have no reason, for
instance, to take potassium supplements unless, perhaps, shes on a
diuretic or some other medication that would cause a potassium depletion.
Is that right?

Baden: Thats correct. Thats right.

Greta: Is there any explanation then in your mind, and I realize you
were not her team physician, but why would a woman at her age have a
potassium imbalance?

Baden: Extremely unusual unless she had certain kinds of diseases,
which she doesnt have. She was in her twenties. The reason that shes in
the state shes in is because there was a period of time, maybe 5 minutes
or 8 minutes, when not enough oxygen was going to her brain. That can
happen because the heart stops for 5 or 8 minutes, but she had a healthy
heart, from what we can see. The other thing, though. . . Im sorry Greta?

Greta: No, go ahead.

Baden: Yeah, your staff has provided me with a bone scan that you guys
obtained ah from her initial admission in 1991 to the hospital. And that
bone scan describes her as having a head injury. Thats why shes there,
thats why shes getting a bone scan. And a head injury can cause, lead to
the vegetative state that Ms. Schiavo is in now, and it does show evidence
that there are other injuries, other bone fractures, that on
healing-stage, so that....

Greta: So, let me back up a second. Head injury. Could she have had,
could she have passed out from a potassium imbalance causing a falling
head injury? Is that what youre talking about, or are you suggesting some
pre-existing head injury to her passing out?

Baden: Something totally different. That its extremely rare for a
20-year-old to have a cardiac arrest from low potassium who has no other
diseases. So the other issue is could it have been due to some other
cause, which is raised by the family, has to be looked at.

Greta: Alright, other injuries and bone injuries, what does that
suggest to you?

Baden: Some kind of trauma. The trauma can be from an auto accident,
the trauma can be from a fall, or the trauma can be from some kind of
beating that she obtained from somebody somewhere. Its something that
should have been investigated in 1991 when these findings were found, and.

to death, a doctor nominated for the Nobel Prize says he believes medical
therapies are still available that could help Terri partly recover from
her disabled state.

Dr. William Hammesfahr is an internationally recognized expert on cases of
brain-injured patients. He has been identified in helping patients with
chronic brain injuries from many causes actually leave long term
disability, and return to work.

Terri Schiavo's injury, hypoxic encephalopathy, is a type of stroke that
he treats every day with success.

"We, and others I know, have treated many patients worse than Terri and
have seen them regain independence and dignity," Hammesfahr said.

"There are many approaches that would help Terri Schiavo," Dr. Hammesfahr
explained. "I know, because I had the opportunity to personally examine
her, her medical records, and her X-rays."

"It is time to help Terri, instead of just warehousing her," he added.
"She would have benefited from treatment years ago, but it is not too late
to start now."

This isn't the first time Hammesfahr has discussed Terri's plight.

Last year, he explained that, after examining Terri, he believed that she
could eventually eat and drink on her own. He also said he believes Terri
would be able to talk and have good use of one arm and one hand should be
given proper rehabilitative treatment.

Hammesfahr also said he thought Terri would eventually be able to transfer
herself from a wheelchair to a bed.

"The patient is not in a coma," concluded Hammesfahr said after observing
Terri. "She responds to specific people best. She tries to please others
by doing activities for which she gets verbal praise."

He says Terri's eyes clearly fixate on her family and she tries to follow
the simple commands her parents give her.
"She looks at you, she can follow commands," Hammesfahr said.

Dr. Hammesfahr was nominated for the Nobel Prize in Medicine and
Physiology in 1999.

I understand that her reflexes can be taken as attempts at communication. On the other hand, it wasn't long ago that scientists believed animal didn't feel pain--their screams, etc. were just reflexes.

Some doctors say her "high level" functioning is gone, only her breathing and pounding heart reamin. I'm hearing a lot of annecdotal examples of folks improving from such a persistant vegetative state. However, I've often heard that the longer one is in that state, the less chance of improvement there is. Terri has been in this state for 15 years. Yet I haven't heard anyone compare the length of time to that of those who have recovered.

U.S. High Court Refuses to Order Schiavo Feeding Tube (Update3)

March 24 (Bloomberg) -- The U.S. Supreme Court refused to order that Terri Schiavo's feeding tube be reinserted, leaving the parents of the brain-damaged Florida woman with a dwindling number of legal options as they fight to keep her alive.

The justices, without comment, today rejected an emergency application filed in Washington by Schiavo's parents, Bob and Mary Schindler. It's the fifth time since 2001 the justices have refused to get involved in the Florida case.

Meanwhile, a state judge denied a bid by the Florida Department of Children and Families that might have permitted the agency to take custody of Schiavo. The judge is still weighing another request by the agency, which says Schiavo might not be in the ``persistent vegetative state'' her doctors have diagnosed.

``Absent a kidnapping, Terri Schiavo is going to remain at hospice,'' said George Felos, a lawyer for Schiavo's husband, who has waged the legal battle to remove the feeding tube. ``Terri is peaceful. She is dying. She is in her death process,'' Felos said.

The Schindlers also filed a new request with a federal judge in Tampa to order the feeding tube reinserted. The judge, James Whittemore, earlier this week rejected a similar request.

Today's Supreme Court action may mark a culmination of a fruitless effort to use a new federal statute, signed by President George W. Bush three days ago, to prolong Schiavo's life. Medical experts say Schiavo may have only days to live unless food and water are restored.

The Supreme Court rejected the application in a one-sentence order without published dissent. Justice Anthony M. Kennedy, who is assigned to handle emergency matters from Florida, had referred the application to the full court.

Severe Brain Damage

The decision ignores ``a compelling case for reexamination of the medical evidence,'' said U.S. Senate Majority Leader Bill Frist, a Tennessee Republican. ``It is a sad day for her loving family and for their innocent and voiceless daughter.''

Schiavo, 41, suffered severe brain damage in 1990 when her heart stopped because of a chemical imbalance. Her husband and legal guardian, Michael Schiavo, waged a seven-year legal battle in Florida courts to remove her feeding tube in accord with what he said were her wishes not to be kept alive artificially.

After Schiavo's feeding tube was removed last week, Congress took the extraordinary step of authorizing a federal court lawsuit by her parents. The question before the Supreme Court was whether to order the tube reinserted while that lawsuit goes forward.

Considering the Merits

The three-judge 11th Circuit panel, ruling yesterday, said the Schindlers ``failed to demonstrate a substantial case on the merits of any of their claims.''

``There's no denying the absolute tragedy that has befallen Mrs. Schiavo,'' the court's 2-1 ruling said. ``We all have our own family, our own loved ones, and our own children. However, we are called upon to make a collective, objective decision concerning a question of law. In the end, and no matter how much we wish Mrs. Schiavo had never suffered such a horrible accident, we are a nation of laws.''

The appeals court upheld a ruling issued a day earlier by a federal judge in Tampa. In the last seven years, 19 Florida judges have heard the case and all sided with Michael Schiavo.

Following yesterday's court rulings, the Florida Senate defeated a bill, 21-18, to authorize reattachment of the feeding tube.

Jeb Bush

The Supreme Court in January refused to hear an appeal by Florida Governor Jeb Bush that sought to revive a state law aimed at prolonging Schiavo's life. Last week, the high court again refused to get involved, rejecting requests from the Schindlers and from a U.S. congressional committee.

Governor Bush, the president's brother, said at a press conference yesterday that the new opinion by neurologist William Polk Cheshire Jr. suggests she is in ``a state of minimal consciousness'' rather than the ``persistent vegetative state'' her court-appointed doctors have diagnosed.

Cheshire observed Schiavo at her bedside and examined videotapes of her but did not examine her, Bush said.

``This new information raises serious concerns and warrants immediate action,'' Governor Bush said. ``If there's any uncertainty, we should err on the side of protecting her. We're exhausting all executive options and are continuing to work with the Florida legislature to save Terri's life.''

Separately, the Schindlers filed an amended complaint in federal court, a move that might let them file a new request for a temporary restraining order. The new complaint invokes the Americans with Disabilities Act.

Well, I've been there kids...a husband who had said multiple times "pull the plug if I'm a vegie", with no will..and he had a massive stroke, and was being kept alive artificially and it was up to his wife to decide, because after you get married, legally, the right to decide goes to the spouse...not the state or a judge, or your mom or dad, or the Rutherford Foundation, or the Family Values Coalition, etc.

This is not a disabilities act issue..this women is not disabled..she's a machine with a body attached to it...it's been what..12-15 years for her...

Her husband is trying to carry out her wishes..it's something couples talk about..joke about...and talk about some more...I have no doubt about that..

Her family could never, ever pursue this legally without thee backing of these radical right legal foundations...you can take that to the bank.

After reading the following information, I am in shock that this can be allowed in our country. Judge George Greer, who has consistently ruled against Terri Schiavo's right to life, clearly has a conflict of interest in this case. Why isn't the media questioning this? Why is he being allowed to get away with this? Read for yourself and see if you aren't as outraged as I am.


Judges are impartial, right? Not Judge George Greer, the judge that has ordered Terri Schiavo executed by starvation and dehydration, twice.

Our good ole boy judge has worked side by side as county commissioner with Barbara Sheen Todd (county commissioner) for eight years. Barbara Sheen Todd is on the board of, you guessed it, the hospice where Terri Schiavo is kept prisoner by her husband, Michael Schiavo, who lives with another woman that he has two children with.

Also, Judge Greer's fellow judge, Judge John Lenderman is the brother of Martha Lenderman, also on the, you got it, the same hospice board.

Our fine judge accepted as the basis of his rulings, the questionable testimony of Michael Schiavo that Terri would wish to be killed, yet Michael never stated this until after he had received the 1.2 million dollar settlement during which time he portrayed himself as a loving husband that just wanted to bring his wife home and take care of her.

The judge also accepted as the basis of his rulings, the "opinion" of a third doctor who is the brother of a close associate of George Felos, Michael Schiavo's right-to-kill attorney, and very significantly, former Chairman of, you got it again, the same hospice board, Hospice of the Florida Suncoast, which operates Woodside Hospice in Pinellas Park, Florida. [that's at least three conflicts of interest by now]

Mary Laybak, CEO of Woodside Hospice has direct ties to Euthanasia Society of America and Hemlock for Hospice, an organization that seeks to accelerate the dying process. Federal funds may not be used for these purposes.

The Hospice is a federally funded program designed for terminally ill and those whose death is eminent. Terri has been in Woodside Hospice illegally for three years under Medicaid payments, for free, courtesy of, yep, George Felos. Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services.

US Dept of Health and Human Services is currently trying to collect $14.8 million from Florida Suncoast Hospice, owed to them since 1997. The squeaki-clean(not) Hospice is accused of patient brokering and several lawsuits filed by Attorney Jonathan Alpert are pending.

And back to our friend the judge, just what kind of testimony has he weighted to put Terri in a hell on earth without chance of parole?

Judge Greer refused to acknowledge testimony of 10 doctors and 3 nurses who have cared for Terri and who testify that:

a) Terri is not in a persistive vegetative state

b) Terri is able to be rehabilitated with care and therapy

c) Terri's original injuries are questionable and consistent with spouse abuse and attempted strangulation

d) Terri has been abused and neglected by her husband; denied treatment for infection and possible attempted murder while in nursing home care (discovery of empty insulin vial and temperature in room set at 64 degrees)

Judge Greer instead chose to believe contrary testimony by two of Michael's representatives who are:

a) A doctor who rarely sees Terri (Dr. Gambone who has now resigned as Terri's doctor)

b) Ronald Cranford, Hannipeg County Medical Center , Minnesota who makes an avocation of testifying in cases such as Terri's throughout the country, always on the side of dehydration and starvation.

1) Nurses' testimony: Heidi Law, Carla Sauer-Iyer, Carolyn Johnson have been ignored and dismissed without hearing; each testified that Michael was abusive to Terri and may have attempted to kill her by insulin injection and attempts to induce pneumonia by turning the thermostat in her room to 64 degrees.

2) Michael Baden, top forensic pathologist in country and interviewed on Fox News National Television broadcast October 25, 2003 on Terri's bone scan and injuries states that:

a) Terri's injuries are not consistent with a heart attack; no cardiac evidence to support it b) Extremely rare for potassium imbalance on woman her age and in her good health
c) Injuries are consistent with severe trauma possibly caused by a beating
d) The injuries in medical records warrant an immediate investigation

3) Dr. William Hammesfahr, Nobel prize nominee and neurologist testified that Terri's neck injuries are consistent with only one type of injury: that of strangulation.

4) Terri's doctor, Dr. Gambone resigned; he had previously testified Terri would die within a few days of starvation/dehydration. Terri has an obvious will to live.

5) Michael has enlisted the services of a new doctor, Stanton Tripodis, who has 5 malpractice suits against him. Clearly, Michael is attempting to provide sub-standard care for his wife.

6) Michael is committing adultery by living with another woman who has already born one child with another on the way, thereby creating an obvious conflict of interest as guardian.

7) Michael has committed both perjury (2 counts) and insurance fraud by promising to provide care and therapy for his wife in exchange for the court award of 1.2 million dollars in 1993. No care has ever been provided to Terri.

8) Michael Schiavo has also prevented Terri from undergoing a barium swallow test, a procedure necessary to ascertain the consistency of foods able to be taken by mouth.

9) Co-conspirator George J. Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services. (Attorney Felos is Director of Florida Right to Die and has testified that he can ascertain a person's desire to die by "looking into their eyes and letting their spirit speak directly to him")

10) Investigate Insurance company established in Jan 2001 at the home of Michael Schiavo and his girlfriend/fiancee Jody Centonze. (Jerger and Centonze Insurnace Agency Inc.) Michael is listed on the Board of Directors for the corporation. Note: Insurance is deliberately misspelled in the State of Florida Corporate filing, possibly to avoid investigation.

11) Michael continues to deny Terri the right to receive Holy Communion as part of her Catholic and civil right.

The physician maintains that she did not suffer her brain damage outside the hospital but while she was hospitalized.

According to the physician, if the reports produced are accurate (normal CT brain on Feb. 27, injury on Feb. 25, 1990) then she did not suffer an event of massive ischemia on Feb. 25, 1990, the date of her alleged 'collapse' The physician says that there is no radiologist or neurologist or neurosurgeon in the world that would dispute this as it is impossible. The CT on Feb. 27, 1990, would have been grossly abnormal."

for your comment on 3/23/05.....I looked on Florida's website and sorry to inform you, but Carla A. Sauer IS in the registry.....her Florida license number is RN3155902 and shows that the license is still current, but that she's not actively practicing at this time. It also shows no complaints against her as a professional. Be careful next time you point the finger at someone; it just might get pointed right "back atcha".

As wrong as Michael was for doing what he did, I am not convinced that he was trying to kill her intentionally or to silence her (as if he had beat her through spousal abuse), and also I had mixed feelings about the feeding tube's use for long-term; however, Terri was denied food, water, and basic medical care -and her civil rights were violated -especially considering she died as a result.

Now, I'm not saying she would have lived had my lawsuit picked up one more vote, reheard, and approved on the merits -but we don't know she wouldn't have either! LOL --so, since I came closer to saving Terri (I lost 4-3 at the Fla Supreme Ct, case number SC03-2420, garnering 42.7% of my panel) than Gov Jeb Bush (who lost 7-0, getting 0.0% of his panel) -or even the family (who lost 2-1 in Federal court, getting 33.3% of their panel), I am upset at most of the news media for not giving press on this -perhaps with the 'Free Press; pressure, I would have picked up one more vote.

But thank you for doing your part to give news coverage -and balanced editorial / opinion.
