The two main terrorism charges against Stewart, Conspiracy to Provide Material Support to a Terrorist Organization and Providing Material Support to a Terrorist Organization, were dismissed by District Judge John G. Koeltl after a hearing. Koeltl ruled the statutes as applied to Stewart were unconstitutionally vague.

Koeltl declined to dismiss charges of Consipracy to Defraud the United States and False Statements related to Stewart's and translator Mohammed Yousry's alleged violation of Justice Department gag orders ordering certain criminal defendants held incommunicado except for explicit legal representation.

In your face with a calico cat butt, Ashcroft!
