Dear Sir,

I am writing in regards to the Circuit Court appeal of Jeffrey Michael Luers. Jeffrey is appealing his conviction and sentence relating to the 2000 arson at Romania Chevrolet and attempted arson at Tyree Oil Company, both in Eugene, Oregon.

Notably, this includes conviction on three separate counts of Arson 1, with enhancement to Measure 11, for a single fire at Romania Chevrolet, a fire in which no one was injured. At trial, the State's witness testified that they were in no danger of injury. By his own admission, Jeffrey stated that great care was taken to prevent injury to anyone. The fire was intended to damage property, and property was all that was damaged - less than $40,000 worth. While not dismissing the serious nature of the crime, enhancement to Measure 11 is unwarranted, as there were no injuries and damage was relatively minor.

I also question the conviction on three separate counts of Arson 1 for a single fire. Jeffrey was sentenced to 22 years, eight months, a sentence far greater than that faced by many offenders convicted of violent acts against individuals. For example, Manslaughter 1 carries a 10 year sentence; Attempted Murder, only 7and a half years; Rape 1, 8 years four months. Clearly, Jeffrey's sentence is vastly disproportionate to the crime of burning three vehicles. In fact, his co-defendant received only 66 months. It is my belief that Jeffrey's sentence is due more to his political beliefs than to the severity of the crime.

Therefore, Mr. Myers, it is my sincere hope that you will take these points into account with regards to Jeffrey's appeal, and that you will consider allowing the State of Oregon to concede to a lesser sentence in the interest of justice.

Wow, this is a depressing piece of news - made a little more-so by the first person to post comment on it being yet another weakminded wanker all too willing to help the corporates in their quest to bring us all to heel. They were right about one thing though - this verdict should definitely send a message out to everyone... which is of course what the corporates and their appointed protectors, the judges and courts in the land of the free-with-purchase, intend.

Their message is: 'don't do it, or you'll be punished to the full extent of our power.' The message I think we should all be taking though, is: 'if you're gonna engage in action like this, DON'T GET CAUGHT!!' We've seen time and again that being arrested for a cause does nothing but take another body off the street and put it in jail. DON'T GET CAUGHT!

Of course, I mean no disrespect to Jeff, and I don't claim to know anything at all about his case or particular circumstances... I only say that if you're going to carry out direct actions and criminal destruction, you can't trust these bastards to give you 'justice', you can't trust them at all!!

If there's an unacceptable risk of getting caught and doing time, I would suggest changing tactics, because I just don't think it's worth a damn to be arrested for a cause anymore. 'Live to fight another day'... you know.

Again, not to suggest anything either way about Jeff's particular situation, which I know nothing about except that he got caught and now he's at the mercy of the (for the most part) motherfuckers.

Good luck Jeffery Luers!! Stay strong man!! Hopefully you and your friends and supporters can find a human in-and-amongst all that fucking systematic machinery to help you get some damn JUSTICE!!!!
