A Qwest protection racket?

Is it legal that a company can sell your information to telemarketing companies and then offer to sell you a service that blocks them out?
So we have heard that Qwest is selling their subscriber information to outside marketing firms, as well as using subscriber information for their own telemarketing purposes. Now as an advertised option, we are offered for an extra fee a service and device that will block out these same calls.

I am not a lawyer or law student, but doesn't this seem like the famous protection racket, to sell a service to protect us from something they are encouraging?
